Terms and Conditions

Acknowledgements:  All orders are acknowledged by email within 24-48 hours.  Please contact us immediately if there are any discrepancies in your confirmation of order.

Artwork: When sending us artwork, the better the artwork, the better the outcome.  Please provide vectored artwork, otherwise additional charges will apply.  Acceptable vectored formats are: CorelDraw X5 or lower or Adobe IllustratorCC or lower files.  All fonts must be converted to curves/outlines prior to submission to avoid font problems; factories are not responsible for font conversion problems. Please include a JPG, PDF or hard copy of the artwork to ensure proper transmission of the art file.  Artwork is generally held by our manufacturers for a period of two years; after two years, a full setup charge applies and new artwork is required (unless you have placed a re-order during this two year timeframe).

Art Charges:  We allow for an adequate amount of art time for most orders.  However, any artwork that is not vectorized, will require additional art time, which will be billed at $50.00 per hour.  

Assembly:  Most products come assembled.  We will alert you if products do not come assembled or if additional charges apply for assembly.

Cancellation Charges:  Cancelled orders will be billed $25.00 plus any art and other charges incurred.

Consulting Fee:  As experienced promotional products professionals, we will gladly provide you with unique, memorable ideas, designed expressly for you, our customer.  As such, we retain the right to bill an hourly rate for consultation and design services and product ideas that are above and beyond three hours of time committed.  If an order is not placed, we will bill at our hourly rate of $145.00.

Copyrights:  Litigation arising from alleged infringement of patents, trademarks, and copyrights is the sole responsibility of the customer

Currency: All prices are quoted in US Dollars ($).

Drop Shipments:  If you are shipping to multiple locations, drop shipping charges may apply.

Embroidery & Digitizing: In most cases, if a logo has not been previously digitized (converting art into a digital format capable of being embroidered), an additional charge will apply.  No typeface smaller than 1/4 of an inch will be accepted.  Alternative decorating methods will be suggested if embroidery will not work for specific artwork/order.

General Use:  Most products listed are classified as 'general use' goods and as such are not intended for use by infants or children under 12 years old.

In-Hands Dates:  Planning ahead is always prudent.  If you have a firm in-hands date, please let us know; we will make every attempt to have your goods produced and shipped by the least expensive method.  If you are on a tight deadline, rush production service and shipping services may be necessary.  We will let you know if rush charges and if expedited freight are necessary.  Remember, inclement weather, acts of God, high demand times of the year can cause delays in shipping. 

Intellectual Property and Copyrights:  We are proud of the effort and ideas we put into our bids.  All original content is owned by MarketShare and are protected by copyright, trademark, patent and other intellectual property or proprietary rights laws.

International Shipments:  $25.00 processing and document fee per internationally shipped order.

Less Than Minimum:  On many of our products, you may order less than minimum (of first column pricing), additional charges may apply. If you are requiring a lesser quantity, please contact us for details.

Other:  Additional charges may apply for such things as, but not limited to: set-up charges, copy changes, change of color charges, additional decoration locations, plus sizes in wearables, etc.  We will advise you when these additional charges will apply.

Over/Under Run Charge:  Please allow for an over/under charge of +/- 3-10% over/under run charge on imprinted merchandise. You will be invoiced for the exact quantity shipped.  We will try to ship an exact amount, whenever possible.

PMS Matching Charges: May apply to nonstandard imprint colors.  If you are imprinting a non-standard color, we will let you know the PMS matching charge(s).  Factories will make every attempt to exactly match your PMS color; however, on dark colors and on different surfaces, the imprint color may vary slightly.

Pre-Production Proofs:  Charges will apply on most pre-production runs.  We will inform you of costs prior to production.  Please allow extra time for proof to be produced and shipped.

Product Safety:  Please consult us for Prop 65 and CPSIA safety and production information data on our products; documentation is available. 

Production Time: Production time begins upon factory's receipt and acceptance of artwork. Production times are listed in the provided bid.  Custom products being produced overseas will have a longer lead time than domestically made or printed products.

QCA Rating: Whenever possible, the items we have selected in this bid are Quality Certification Alliance (QCA) certified manufactures; addressing product safety, product quality, supply chain security, social accountability, and environmental stewardship.

Returns: Must be authorized in writing within 5 working days of delivery, or will not be accepted.  Any disputed product must be available for inspection, products that are decorated will only be returnable if defective.  Restocking charges may apply for non-imprinted/decorated goods.

Rush Service: Is available on many products; additional charge may apply. 

Samples: May be provided at no cost or for a nominal fee for a reasonable number of samples.  More expensive products can be ‘memo-billed’ allowing for the return of the sample to the factory manufacturers. Shipping/handling fees may apply.

Set-Up Charges:  Also known as Plate Charges or Embroidery Digitizing Fees will vary per item.  Repeat set-up charges on exact repeat orders may also apply.  Set-up charges are listed on within the customer’s quote.

Shipping: The standard method of shipping is via UPS or FedEx ground service. If expedited shipping is required, please notify us.  If you wish to use your own UPS or FedEx account, please provide us with your shipping I.D. number.  A third party charge may apply if you are using your own account number. Freight charges are published rates plus a handling charge and fuel surcharge (where applicable).  Freight estimates are available, please consult with us once you know the quantities of product(s) being ordered and their ship to location(s).

Taxes and Duties: If you are tax exempt, please provide us with the appropriate documentation. Taxes and duties on international shipping locations will be invoiced to the customer.

Terms:  Unless credit has been established, payment is required at the time the order is received.  Production will not begin until payment has made. 

Validity: This bid is valid for 30 days, unless otherwise noted. On electronic/tech goods, terms are typically valid for a lesser period of time.

Virtual Proofs:  It is always advisable to see a virtual proof prior to production of your goods.  Typically, the first proof is provided at no charge; subsequent proofs will be invoices at a nominal fee.  Proof charges, if applicable, are provided on the customer’s quote.  Upon approval of virtual proof, production is started and products will only be returnable if defective.
